Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Buried Belief website at buriedbelief.com and any related services, including the writing workspace made available to readers of the Buried Belief book (together, the "Services"). The Services are provided by Mike Martin, trading as Buried Belief ("Buried Belief", "we", "us", "our"). By using the Services you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 16 years old to use the Services. By using the Services you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Accounts

Some parts of the Services require an account. You are responsible for keeping your login credentials confidential and for all activity that happens under your account. Notify us immediately at story@buriedbelief.com if you suspect unauthorised use. We may suspend or terminate accounts at our discretion, including for breach of these Terms.

3. Acceptable use

You agree not to:

• Use the Services for any unlawful, fraudulent or harmful purpose.
• Attempt to access accounts, data or systems you are not authorised to access.
• Probe, scan, reverse engineer, decompile or attempt to defeat the security of the Services.
• Introduce viruses, malware or other harmful code.
• Scrape, harvest or bulk-download content without our written permission.
• Use the Services in a way that could damage, disable, overburden or impair them.
• Upload content that is unlawful, infringing, defamatory, obscene, harassing or otherwise objectionable.

4. Your content

You retain all ownership of the content you create in the workspace ("Your Content"). You grant Buried Belief a limited, worldwide, non-exclusive, royalty-free licence to host, store, transmit and back up Your Content solely to provide the Services to you. You are solely responsible for Your Content and for keeping your own copies.

5. Our content and intellectual property

The Services, including the Buried Belief brand, book, methodology (including the BELIEF and FOCUS frameworks), text, graphics, logos, code and any related materials, are owned by Buried Belief or its licensors and are protected by intellectual property laws. Except for the limited access rights expressly granted in these Terms, no rights are granted. You may not copy, modify, distribute, sell, publish or create derivative works from any part of the Services without our prior written permission.

6. Reader access and access codes

Access codes distributed with the Buried Belief book allow readers to create a free workspace account. Access codes are for personal, non-commercial use, must not be shared, resold or published, and may be revoked at any time.

7. Third-party services

The Services rely on third-party providers (for example hosting, authentication, email delivery and scheduling). We are not responsible for the acts, omissions, content or availability of third-party services, and your use of them may be governed by their own terms.

8. Fees

The Services are currently offered without charge. We may introduce paid features in future, in which case pricing and payment terms will be presented before you purchase.

9. No professional advice

The content on the Site and inside the workspace is provided for informational and educational purposes only. It is not legal, financial, tax, investment or other professional advice, and no client relationship is created by your use of the Services. You are solely responsible for any decisions you make based on it.

10. Availability and changes

We work to keep the Services available but do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue any part of the Services at any time, with or without notice, without liability to you.

11. Disclaimers

To the fullest extent permitted by law, the Services are provided "as is" and "as available", without warranties of any kind, whether express, implied, statutory or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy or uninterrupted use. We do not warrant that the Services will meet your requirements, that any information provided will be accurate or reliable, or that defects will be corrected.

12. Limitation of liability

To the fullest extent permitted by law, in no event will Buried Belief, its owner, employees, contractors, partners or suppliers be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenues, business, goodwill, data, or other intangible losses, arising out of or relating to your use of, or inability to use, the Services, even if advised of the possibility of such damages. Our total aggregate liability for all claims arising out of or relating to the Services or these Terms will not exceed the greater of (a) the amounts you paid us in the twelve months preceding the event giving rise to the claim, or (b) one hundred pounds sterling (£100). Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded, including for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

13. Indemnity

You agree to defend, indemnify and hold harmless Buried Belief and its owner, employees, contractors, partners and suppliers from and against any claims, damages, liabilities, losses, costs and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; (c) Your Content; or (d) your violation of any law or the rights of any third party.

14. Termination

You may stop using the Services at any time. We may suspend or terminate your access to the Services, in whole or in part, at any time and without prior notice, for any reason including if we reasonably believe you have breached these Terms. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability and indemnity.

15. Governing law and jurisdiction

These Terms and any dispute arising out of or in connection with them (including non-contractual disputes or claims) are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction to settle any such dispute, except that we may bring proceedings in any jurisdiction where you are located to protect our rights.

16. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the "last updated" date at the top. If changes are material, we may notify you by email or via the Services. Your continued use of the Services after changes take effect means you accept the updated Terms.

17. Miscellaneous

These Terms are the entire agreement between you and Buried Belief regarding the Services and supersede any prior agreements. If any provision is held unenforceable, the remaining provisions will remain in full force. Our failure to enforce any right or provision will not be a waiver of that right. You may not assign these Terms without our prior written consent; we may assign them freely.
